NOTICE OF APPLICATION FOR RECLAMATION DEFERMENT

In accordance with 405 KAR 16:020, notice is hereby given that Mountainside Coal Co., Inc., 7692 S. HWY 25W, Williamsburg, KY 40769 has applied for a coal marketing reclamation deferment for its surface coal mining and reclamation operation, permit number 861-0543. Deferment of reclamation is being requested for approximately 2.3 acres. The operation for which the deferment is being requested is located approximately 1.2 miles north of the intersection of Hwy. 779 and Hwy. 1418 near Permon in Knox and Whitley Counties. The latitude is 36° 49’ 33” and the longitude is 84° 0’ 53”.

The Surface owners for the property proposed for deferment are as follows: Robert Lambdin, Vickie Partin, Charles Cupp, Carolyn Moses, David Monhollen, Glenn Lawson, Willard Wayne Hubbs, Donald Mackey, Calvin Jones, James Carter, Harold Edward Ward, Venda Hill, Joyce Lawson, Debbie Lawson and Gino Cima.

The deferment is being sought due to coal marketing problems and is being requested for an initial period of six (6) months. The deferment may be renewed for additional periods, in six (6) month increments, up to a maximum of Thirty (30) months.

The application has been filed for public inspection at the Department for Natural Resources’ Middlesboro Regional Office, 1804 East Cumberland Avenue, Middlesboro, Kentucky 40965. Written comments or objections must be filed within ten (10) days of this notice with the Director, Division of Permits, 300 Sower Boulevard, Frankfort, Kentucky 40601.
