Sheriff: Evarts man’s DUI arrest in Laurel County makes his third

An Evarts man is facing his third DUI charge after a Laurel County Sheriff’s deputy found him passed out in his vehicle in a parking lot in Lily Friday night.

According to Sheriff John Root, Deputy Shawn Jackson arrested 32-year-old John Delph about 11:50 p.m. at a location off of Greta Lane off of East Ky. 552.

Root stated that Jackson was dispatched to a complaint that a male subject, later identified as Delph, had pulled into the parking lot to wait for a friend to get off work.

When Jackson arrived, he reportedly found Delph still out cold and had to awaken him.

Upon further investigation, Root stated that Jackson determined that Delph was under the influence.

“This subject (Delph) stated he had done three Suboxone strips prior to driving the vehicle to the parking lot,” Root stated.

Delph was charged with operating a motor vehicle while under the influence – third offense, failure of non-owner operator to maintain required insurance, no registration plates and failure to wear seatbelts.

In addition, Delph was served with two outstanding warrants from Harlan County. The first was for second-degree assault and the second is for non-payment of fines.

Delph was transported to the Laurel County Detention Center where he is being held on a $5,000 cash bond.
