If you’re going to have marijuana laying around on a table and the cops knock on your door wanting you to come outside and speak to them, then it’s probably not a good idea to insist they come inside to speak with you.
Whitley County Sheriff’s deputies say that is exactly what happened while they went to answer a disturbance call Wednesday in the Bee Creek community.
Deputies Cody Harrell and David Rowe went to the residence at 100 Osborne Lane, but the homeowner refused to come outside to speak with police, Deputy Shawn Jackson said in a press release.
"He insisted that the deputies come in and talk with him inside the residence," Jackson wrote.
When they got inside, Rowe and Harrell noticed a small amount of what appeared to be marijuana laying on a table in "plain view," Jackson wrote.
Jackson soon arrived at the residence to assist with the investigation. Officers received "consent to search" the residence where they discovered another small amount of what appeared to be marijuana hidden in a pill bottle in the back room of the residence. In addition, other items of paraphernalia were discovered throughout the residence, Jackson wrote.
Jackson added that over the last few weeks, deputies have received complaints about a lot of traffic in the Bee Creek area involving possible drug activity.
Deputies arrested and charged Bennis "Benny" Brown, 42, and Deborah Brown, 53, both of 100 Osborne Lane, with possession of marijuana and possession of drug paraphernalia.
Deputies also charged a third person at the residence, Timothy Leach, 40, of Young’s Chapel Road,with possession of marijuana.
During their arraignments Thursday morning in Whitley District Court Bennis Brown and Leach both pleaded guilty, and received probated 30-day jail sentences.
Harrell and Rowe are continuing the investigation.
