ORDINANCE NO. 2024-9
AN ORDINANCE OF THE CITY OF CORBIN, KENTUCKY, ASSIGNING ZONING CLASSIFICATIONS TO THE COMMONWEALTH OF KENTUCKY REGULATING MEDICAL CANNABIS LICENSING FRAMEWORK
WHEREAS, the Commonwealth of Kentucky has legalized and created a regulatory framework for Medical Cannabis; and
WHEREAS, the City of Corbin, Kentucky, pursuant to KRS 218B has approved by this Ordinance the operation of Medical Cannabis Business Operations in the City of Corbin, Kentucky; and
WHEREAS, the Board of Commissioners of the City of Corbin, Kentucky has carefully considered the Kentucky General Assembly’s Medical Cannabis legalization and framework created by KRS 218B and now by this Ordinance defines and assigns zoning classification to medical cannabis-based businesses within the City of Corbin, Kentucky.
NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of the City of Corbin, Kentucky, as follows:
SECTION 1: The City of Corbin, Kentucky hereby adopts and incorporates herein by reference the definitions as established and set forth in KRS 218B.
SECTION 2: Medical Cannabis Cultivators, including Tier I, Tier II, Tier III, and Tier IV, shall be permitted, regulated, and restricted in operation, only within the boundaries of the Zoning Classification of Industrial Park District (IP).
SECTION 3: Medical Cannabis Dispensaries shall be permitted, regulated, and restricted in operation only within the boundaries of the Zoning Classifications of General Business District (C-1), Central Business District (C-2), and Planned Shopping Center District (C-3).
SECTION 4: Medical Cannabis Processors shall be permitted, regulated, and restricted in operation only within the boundaries of the Zoning Classification of Industrial Park District (IP).
SECTION 5: Medical Cannabis Producers shall be permitted, regulated, and restricted in operation only within the boundaries of the Zoning Classification of Industrial Park District (IP).
SECTION 6: Medical Cannabis Safety Compliance Facilities shall be permitted, regulated, and restricted in operation only within the boundaries of the Zoning Classification of Industrial Park District (IP).
SECTION 7: No Medical Cannabis business licensed under KRS 218B and/or permitted under this Ordinance shall be located, permitted, and/or operated or conduct business within one thousand (1,000) feet of an existing elementary or secondary school or a daycare center (a daycare being a place of business as defined by KRS 199.894(3)) or an existing and operating church or house of worship.
SECTION 8: Unless expressly permitted by Zoning Classifications in this Ordinance, all Medical Cannabis businesses, operations and/or uses permitted and regulated by KRS 2188 are hereby prohibited and not allowed in the City of Corbin, Kentucky.
SECTION 9: The privilege/business license fees for Medical Cannabis Cultivators set forth in SECTION 2. above, Medical Cannabis Processors set forth in SECTION 4. above, Medical Cannabis Producers set forth in SECTION 5. above, and Medical Cannabis Safety Compliance Facilities set forth in SECTION 6. above shall be as set forth in Ordinance No. 6-2005 SECTION 108. The privilege/business license fees for Medical Cannabis Dispensaries as set forth in SECTION 3. above shall be as set forth in Ordinance No. 6-2005 SECTION 173.
SECTION 10: In the event any portion and/or provision of this Ordinance is deemed by a Court of competent jurisdiction to be unenforceable or unconstitutional, the remaining portions and/or provisions shall continue in full force and effect.
SECTION 11: This Ordinance shall be in full force effect upon due passage and legal advertisement.

REQUEST FOR STATEMENT OF QUALIFICATIONS
The City of Williamsburg, Kentucky is accepting Statement of Qualifications for engineering planning, design, inspection and supervision services to be performed for water/wastewater related projects. These projects may be funded with USDA RUS Rural Development (RD), Community Development Block Grant (CDBG), Community Project Funding Grants (CPF), State Revolving Funds (SRF), Cleaner Water Program Grants (CWP), other federal/state funding programs and the City of Williamsburg.
DETERMINATION:
For consideration, statements must be received prior to 4:00 PM EST on Wednesday, December 18th, 2024. They should be sealed and labeled “City of Williamsburg – Water and Wastewater Engineering Services”. The City of Williamsburg reserves the right to reject any and all responses, to waive any technicalities, and to negotiate with the respondent who most nearly meets the project requirements.
Statements of Qualifications will be evaluated and ranked on the basis of the following considerations:
- Experience or technical expertise of the firm with regard to the type of services to be provided and projects of a similar nature.
- Past record of performance on contracts with the locality and other clients, including quality of work and timeliness.
- Capacity of the firm to work within time limitations, taking into consideration the current and planned workload of the firm.
- Proximity and accessibility of the firm to the City of Williamsburg.
- Familiarity with the locality and project requirements.
Statement of Qualifications should include the following information:
- Outline the experience and qualifications of the firm and the individual(s) to be assigned to the project.
- Describe past record of the performance with the locality and with other clients. Include the name and number of a contact person for each reference project.
- Outline the firm’s capacity for performance. Describe the time frame for services to be provided and staffing considerations such as availability, workload, etc.
- State the base of operation for the firm and briefly analyze accessibility to the locality.
- Describe degree of familiarity with locality.

After the close of evaluations, the City of Williamsburg will contact the highest ranked firm and enter negotiations. If the City of Williamsburg is unable to negotiate a satisfactory agreement, the second-ranked firm will be contacted. Once a firm has been selected, all unsuccessful candidates will be promptly notified.
The City of Williamsburg will adhere to the provisions of the Title VI of the Civil Rights Act of 1964, Section 3, and Section 109 of the Housing and Community Development Act of 1974 in the implementation of this project.
No person shall be excluded from participation in, denied benefits of, or subjected to discrimination in the implementation of this program on the grounds of race, color, national origin, sex or age.
Attention is particularly called to the requirements as to conditions of employment to be observed under the contract, Section 3, Segregated facilities, Section 109, Title VI of the Civil Rights Act of 1964, E.O. 11246, the Anti-Kickback Act, and Section 504/ADA requirements.
