In accordance with the provisions of KRS 350.055, notice is hereby given that B&B Energy, LLC, P.O. Box 1016, Williamsburg, KY 40769, has applied for a permit for a surface coal mining operation, located 7.6 miles southwest of Barbourville in Knox and Whitley Counties, Kentucky. The proposed permit area will disturb 53.0 acres and underlie 0 acres, for a total area within the permit boundary of 53.0 acres. The proposed operation is located approximately 0.5 miles east of the junction of County Road 1530 and Owens Cemetery Road. The proposed operation is located 0.3 miles east of Owens Branch.
The proposed operation is located on the Barbourville U.S.G.S. 7 1/2 minute quadrangle map. The permit surface area to be disturbed is owned by Roy Baker, Myra Sizemore and Star Miller.
The operation will affect an area within 100 feet of Miller Town Road. The operation will not involve relocation and/or closure of the public road.
This is the final advertisement of this permit application. All comments, objections or requests for a permit conference must be received within thirty (30) days of today’s date. The application has been filed for public inspection at the Department for Natural Resources’s Middlesboro Regional Office, 1804 Cumberland Ave., Middlesboro, Kentucky 40965.

Delta Natural Gas Company, Inc. proposes a new Pipe Replacement Program tariff. Delta Natural Gas Company, Inc. also proposes a change to the Gas Cost Recovery tariff that provides recovery of Uncollectible Gas Costs through the GCR mechanism. The foregoing rates reflect an annual proposed increase in revenues of approximately 11.54% to Delta Natural Gas Company, Inc. The estimated amount of annual increase per customer class is as follows: Residential GS: $ 3,539,053, 15.8%; Small Non-Residential GS: $ 593,368, 9.2%; Large Non-Residential GS: $ 668,718, 7.3%; Interruptible: $ 0, 0%; On-System Transportation: $ 261,259, 6.3%; Off-System Transportation: $ 253,030,7.4%. Notice is further given that any corporation, association, body politic or person with a substantial interest in the matter may by written request, within thirty (30) days after publication of the notice of the proposed rate changes, request to intervene. The motion shall be submitted to the Public Service Commission, 211 Sower Boulevard, P. O. Box 615, Frankfort, Kentucky 40601, and shall set forth the grounds for the request, including the status and interest of the party. Intervention may be granted beyond the thirty (30) day period for good cause shown.
