Allen Scott Miller, who allegedly head butted a state trooper as he continued to fight with Whitley County Sheriff’s deputies, Corbin and Williamsburg Police, a constable and Kentucky State Police even after he had been handcuffed, will return to Whitley District Court Tuesday for a preliminary hearing to determine if the case should be presented to a grand jury.
Kentucky State Police Trooper Don Trosper, public affairs officer at Post 11 in London, said Trooper Jason Bunch was treated and released from Baptist Regional Medical Center for a bruised chest following the incident.
According to police, the situation began about 7:30 p.m. on Aug. 27 when Whitley County Sheriff’s Deputy Adam Jarboe was called to a 1017 Bee Creek Road in response to a complaint of a fight in progress and encountered Miller.
According to the arrest citation, Miller began cursing at Jarboe and got into a fighting stance. Jarboe said he used his "pepper" spray to try to get control, but it was unsuccessful. Jarboe requested backup, but while waiting for it to arrive, he said Miller jumped a fence and continue the fight with the neighbor that precipitated the call. Deputies, police, a constable and two state troopers responded.
"Upon their arrival, Miller had been placed in handcuffs but continued to fight," Trosper said. "He charged Trooper Bunch, striking Bunch in the chest with his head. He then charged at Trooper (Dwayne) Foley. Foley kicked him away and tried to use his Taser, but only one prong hit Miller, making the Taser ineffective."
Bunch then deployed his Taser. Trosper said Bunch’s Taser sent Miller to the ground, during which he struck his head on the concrete porch.
Miller was also taken to BRMC, for what Trosper described as a minor contusion on his head and then released into the custody of law enforcement.
Miller was charged with second-degree assault, third-degree terroristic threatening, two counts of resisting arrest, third-degree assault on a police officer and menacing and lodged in the Whitley County Detention Center.
According to court records, Whitley District Judge Cathy Prewitt released Miller from Jail Tuesday. He is to remain on house arrest at his parents’ home pending trial.
